Ohmycad has always recognized the importance of protecting personal data for its partners operating in the digital age. It is also aware of the responsibilities involved in processing personal data.

This Privacy Policy outlines Ohmycad’s practices regarding the protection of personal data in connection with the collection, use, retention, or other processing of personal data in connection with its websites, mobile applications (where this Privacy Policy is referenced), social media pages (“Sites”), and the products and services provided by Ohmycad to its customers (“Services”). It explains the rights and choices available to individuals regarding their personal data.

Please note that additional country-specific terms and conditions may apply, as indicated at the end of this Policy.

Scope of this policy: summary

This Policy applies to the processing of personal data carried out by Ohmycad as the data controller, that is, as the entity that determines the categories of personal data to be collected online or offline, as well as the purposes for which such data is collected.

This Policy does not apply to:

  • Personal Data of Ohmycad Employees and Job Applicants
  • Personal data that Ohmycad processes on behalf of its clients or other third parties, as specified in the applicable contract.

This Policy provides information on:

  • The types of personal data that Ohmycad may collect about you (for example, your contact information);
  • How personal data is collected;
  • The purposes and legal basis for processing your personal data (for example, to comply with the law, or for marketing purposes with your consent);
  • Your rights and choices regarding your personal data: Depending on your jurisdiction, you may have legal rights related to Ohmycad’s processing of your personal data, including the right to access, correct, delete, or transfer your personal data, or to object to its processing. Regardless of where you live, Ohmycad will honor your request to opt out of being contacted for marketing purposes;

To make your searches easier, hyperlinks may be posted on Ohmycad’s Sites that point to other websites or applications that Ohmycad does not own or control. This Policy does not apply to those sites, and Ohmycad assumes no responsibility for the content of third-party websites. Ohmycad encourages you to read the privacy policies of the other websites you visit and the services you use.

Personal data collected and processed by Ohmycad

Personal data is any information relating to an identified or identifiable natural person. A person is “identifiable” if they can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to them.

In any case, Ohmycad’s processing of personal data is limited to the data necessary to achieve the purposes set forth in this Policy.

Depending on the purposes detailed below, Ohmycad processes the following personal data:

  • personal and professional contact information, such as first and last name, mailing address, email address, phone number(s), and job title;
  • profile information such as user ID, username, and password; profile photo; university; degree; certifications; courses taken; type of organization (company, school, etc.), name, size, department, industry, and industrial subsectors;
  • transaction information: purchases made, in particular, through the Ohmycad website; event registrations; billing information (such as credit card and bank account information); and signatures;
  • Health-related data: If you attend an event organized by Ohmycad, you may be asked to provide health information so that we can identify and accommodate individuals with disabilities or special dietary needs, as well as other personal data necessary for processing throughout the event;
  • usage information such as IP and MAC addresses, logs regarding how you use Ohmycad’s Services, including data from cookies as described below and through the Ohmycad Marketing Preferences Center, if applicable.

Ohmycad may collect this personal information through the following means:

  • Directly from you through the Services or communicated in another manner;
  • Automatically;
  • Through third parties, such as: your employer, school, or other organization to which you belong; third parties you have authorized to share your personal data with Ohmycad; and public databases.

The provision of personal data identified as required is voluntary but is necessary to provide you with Ohmycad Services.

Please note that Ohmycad Services are not intended for children who are considered minors under applicable data protection laws. If you are a minor, you are not permitted to use Ohmycad Services unless you have prior permission from your parents or guardians. If Ohmycad learns that it has collected personal data from a child, it will delete that information as soon as possible.

Why is Ohmycad processing your personal data?

Ohmycad uses your personal data in accordance with the law. The legal bases and purposes for which Ohmycad processes your personal data are described below:

With your consent

  • To communicate with you, particularly when you request information about Ohmycad Services, register on the Ohmycad Website, participate in surveys, or allow Ohmycad to take specific actions (for example, publish your testimonials or recommendations on the Ohmycad Website), and more generally to manage Ohmycad’s communication and marketing activities;
  • To identify your needs and interests and provide you with the Services that best suit you;
  • To provide you with an interactive and personalized experience on the Ohmycad website, as well as access to all of its features;
  • To allow you to display certain personal information associated with your profile when exchanging ideas and other information on the Ohmycad Services with other users of the Ohmycad website, including the 3DEXPERIENCE platform.

Enter into an agreement to provide Ohmycad Services

  • To allow you to register for an event, seminar, or webinar; to participate in a contest; to track and manage the events you have registered for and participated in; and to join the Ohmycad community forums;
  • Create an account to access Ohmycad Services and obtain an identifier such as the “3DEXPERIENCE ID”;
  • To enable Ohmycad to manage its business relationships with you (in connection with business opportunities, commercial offers, purchases, contracts, orders, invoices, delivery, support services, including essential information for users of Ohmycad Services, and the security of the Services or Ohmycad’s professional services);
  • Manage your training and/or certification on Ohmycad Services, which may include tracking your learning progress in order to make this information available to you;
  • To operate, maintain, manage, and improve the Services.

To address the following legitimate interests

Ohmycad considers and assesses the potential impact (both positive and negative) of processing your personal data on your privacy, as well as the rights you have, before proceeding with such processing for purposes based on legitimate interests. Unless Ohmycad has obtained your consent or the law provides otherwise or authorizes such processing, Ohmycad will not use your personal data in situations where the impact of its processing on your privacy is such that it outweighs Ohmycad’s legitimate interest in processing your personal data for:

  • To improve your experience, better understand your needs and interests, and personalize your experience with Ohmycad Services, including remembering your settings;
  • Allow Ohmycad to manage its marketing activities for similar products or services if you are already using Ohmycad Services;
  • Allow Ohmycad to manage its business relationships when you are acting on behalf of an Ohmycad prospect or customer;
  • Manage 3DS's Anti-Piracy and Compliance Program;
  • Create anonymous data for analytical purposes;
  • To protect against, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activities, as well as to ensure security and prevention, as part of the 3DS Cybersecurity Program.

Ohmycad may combine your personal data with other relevant publicly available information or with personal data collected through other processing activities.

Comply with the law

  • Manage Ohmycad’s obligations under compliance laws, including anti-corruption laws, applicable export laws, trade sanctions, and embargoes issued, among others, by the European Union and its member states, the United States of America, and other countries as applicable. This may include (i) automated checks of all user registration data as set forth in this Policy and other information you provide regarding your identity against lists of sanctioned individuals; (ii) regular checks whenever a list of sanctioned individuals is updated or when you update your information; (iii) blocking access to Ohmycad’s Services in the event of a potential match; and (iv) contacting you to confirm your identity in the event of a potential match;
  • Store your financial data with a third-party payment provider;
  • To comply with legal requests and procedures, such as responding to subpoenas or requests from government authorities, as detailed below.

How long does Ohmycad retain your personal data?

Ohmycad does not retain your personal data any longer than necessary; it is retained only for as long as is required to fulfill the purposes described above. Retention periods may vary depending on the categories of data and the processing activities.

To determine the appropriate retention period for personal data, Ohmycad takes into account the amount, nature, and sensitivity of the personal data, the potential risk of harm arising from the unauthorized use or disclosure of your personal information, the purposes for which Ohmycad processes your personal data and whether Ohmycad can achieve those purposes by other means, as well as applicable legal requirements:

  • when you have given your consent, until you withdraw it;
  • when Ohmycad has entered into a contract with you or your employer, depending on the term of the contract plus any applicable local statutes of limitations;
  • when Ohmycad has a legitimate interest in using your personal data, for a limited and appropriate period of time to ensure the fair processing of your personal data or until you object to the use of your personal data, subject to Ohmycad having compelling and legitimate grounds for continuing the processing that override your interest in objecting, or for the establishment, exercise, or defense of a legal claim;
  • When Ohmycad is required to comply with a legal obligation, the retention period will be determined in accordance with applicable law;
  • When your personal data is necessary to establish Ohmycad’s rights or to defend against legal actions, Ohmycad will retain your personal data until the end of the applicable retention period or until the final resolution of the relevant legal actions.

At the end of the retention period, your personal data will be deleted or anonymized using processes and methods that comply with data protection standards.

Who Ohmycad Shares Your Personal Data With

Ohmycad does not rent or sell information, but may share your personal data, which is necessary to fulfill certain business purposes, with the following categories of organizations:

At Ohmycad

Due to its international scope, Ohmycad may need to share your personal data for purposes consistent with this Policy (for example, to provide you with support services).

With trusted Ohmycad partners

  • Sponsors of events or marketing campaigns: Ohmycad may share your personal data with trusted sponsors with whom Ohmycad organizes events or promotional marketing campaigns. When you register for an event organized by Ohmycad, Ohmycad may share your name, your company’s contact information, and your email address with other participants and sponsors of the same event for the purposes of communication and exchanging ideas.
  • Ohmycad's business partners: Ohmycad may share your personal data with Ohmycad’s business partners, such as the resellers assigned to you, in order to provide you or your employer with appropriate offers or Services.
  • Third parties acting on behalf of Ohmycad: Ohmycad may engage third-party companies and individuals as necessary and disclose your personal data to them in connection with the services they provide to Ohmycad, to administer and provide the Services on behalf of Ohmycad (such as training, customer support, hosting, payment services to enable you to purchase Ohmycad Services, email delivery, and database management services). These third parties will use your personal data solely in accordance with Ohmycad’s instructions and in a manner consistent with this Policy, and they are prohibited from using or disclosing your personal data for any other purpose.

To third parties to comply with applicable laws

Under certain circumstances, Ohmycad may, in accordance with applicable law, disclose certain of your personal data to government authorities, law enforcement officials, or private parties, (a) if Ohmycad believes in good faith that such disclosure is reasonably necessary to comply with a legal proceeding (for example, a warrant, subpoena, or other court order), (b) enforce the terms and conditions governing the Ohmycad Services, (c) protect the rights, property, or safety of Ohmycad, Ohmycad’s customers, or the public; and (d) to protect against, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activities. Ohmycad will review requests to ensure they comply with applicable laws. If a request contains excessive information, Ohmycad will attempt to narrow its scope and, if possible, object to the disclosure of information.

To third parties to serve or protect Ohmycad’s legal and business interests

Ohmycad may sell, transfer, or otherwise share all or part of its business or assets, including your personal data, as part of a business transaction (or a potential business transaction) such as a merger, consolidation, acquisition, reorganization, or sale of assets, or in the event of bankruptcy, a change of control, or the total or partial liquidation of Ohmycad, in which case Ohmycad will make reasonable efforts to require the recipient to comply with this Privacy Policy.

International data transfers

When you access an Ohmycad Site, please note that by continuing to use it, if you are located in a country other than the one where the Ohmycad Site is based, you consent to the transfer of your personal data to a country other than your own, where data protection laws may not provide the same level of protection as those in your country.

As part of its multinational organization, Ohmycad may need to transfer your personal data from one country or region to another country or region, including anywhere in Africa, Asia, Europe, and the Americas. This may occur, for example, when Ohmycad provides you with services such as training, customer support, or hosting services.

Whenever Ohmycad transfers your personal data to countries that are not considered by the authorities in your country (for example, the European Commission) as providing an adequate level of personal data protection, the transfer will be based on safeguards recognized by the authorities in your country as providing adequate protection for personal data, such as the standard contractual clauses issued by the European Commission, your informed consent to the transfer, or any other relevant mechanism. What are your rights?

Depending on applicable data protection laws, you may have all or some of the following rights regarding your personal data:

  • the right to access your personal data;
  • the right to obtain a copy of your personal data held by Ohmycad;
  • the right to request that your personal data be corrected, supplemented, updated, or deleted;
  • the right to restriction of processing;
  • the right to object to a specific processing of your personal data if such processing is based on legitimate interests;
  • the right to data portability.

If the processing of your personal data is based on your consent, you have the right to withdraw that consent at any time (for example, by requesting to unsubscribe from marketing communications).

For any request to Ohmycad, please contact a member of the Ohmycad team. Depending on the scope of the request, Ohmycad may charge the requester a reasonable fee to cover the costs incurred in connection with such a request. Ohmycad reserves the right to deny you access to your personal data in specific cases provided for by applicable laws and regulations. Ohmycad may ask you for specific information to verify your identity or process your request. Applicable laws may require or authorize Ohmycad to deny your request, but in any case, Ohmycad will provide you with an explanation of its position, subject to legal restrictions.

Data Security

Ohmycad has implemented appropriate technical and organizational safeguards to prevent any loss, misuse, unauthorized access or disclosure, alteration, or destruction of your personal data during its transmission to Ohmycad and while it is in Ohmycad’s possession. However, despite Ohmycad’s efforts to protect your personal data, Ohmycad cannot guarantee that this protection is foolproof against data breaches due to unavoidable risks associated with the Internet.

It is important that you take precautions to prevent unauthorized access to your personal data. You are responsible for keeping your password and account information confidential. Therefore, you must make sure to log out if you are sharing a computer with others.

Cookies Used by Ohmycad

To improve your browsing experience on Ohmycad’s Services, Ohmycad uses cookies or other similar technologies that may process your personal data. Ohmycad uses different types of cookies depending on the Services in question:

  • Strictly necessary cookies are always used; they are essential for you to use the Ohmycad Services properly and cannot be disabled. For example, they allow you to save your personalization settings (language selection, service layout, and shopping cart contents).
  • Functional cookies are used to improve the performance of Ohmycad’s Services, to provide you with enhanced features and a more personalized experience by collecting information when you use Ohmycad’s Services. Ohmycad is committed to protecting your personal data. You can contact Ohmycad if:

  • if you encounter any difficulties accessing your personal data or regarding your rights set forth above;
  • you believe that Ohmycad is not complying with the GDPR or applicable local data protection laws;
  • You have reason to believe that the security of your personal data has been compromised or that it has been misused.

Ohmycad reserves the right to modify and update this Policy at any time in accordance with Ohmycad’s requirements and circumstances, or when required by applicable laws and regulations. Ohmycad encourages you to check this page regularly for the latest information on its data protection practices.

In the event of major changes to this Policy, Ohmycad may notify you by email or by any other means that Ohmycad reasonably believes is appropriate to contact you. This may include posting a specific notice on the Ohmycad Sites. Any changes to this Policy will take effect as soon as Ohmycad publishes the new terms and/or implements the new changes in the Services.

Specific provisions applicable to certain countries or regions

Depending on where you live, certain additional terms may apply to you. When this Policy refers to “personal data,” it should be interpreted, where applicable, as “personal information” as defined by applicable data protection laws.
